This page summarizes privacy rights that may apply to you depending on where you live, and explains how to contact UpChat to exercise those rights.

UpChat is operated by Actuate Media, LLC (“UpChat,” “we,” “us,” or “our”). This notice supplements our Privacy Policy. It does not replace that policy.

We do not sell your personal information.

We do not share your personal information for cross-context behavioral advertising (including as “sharing” is defined under California law).

Because we do not sell or share personal information for these purposes, there is generally nothing to opt out of with respect to sale or sharing. If you still wish to confirm or document your preference, see Do Not Sell or Share My Personal Information or contact us using the information in Section 8 below.

If your browser or device sends a Global Privacy Control (GPC) signal, we treat it as a request to opt out of the sale or sharing of personal information, to the extent applicable law requires us to honor that signal.

3. Targeted Advertising and Profiling

UpChat does not use personal information for targeted advertising, retargeted advertising, or interest-based advertising on third-party websites or platforms.

We do not make decisions based solely on automated processing that produce legal or similarly significant effects concerning consumers, as described in some state privacy laws.

4. Sensitive Personal Information

Some state laws provide additional rights regarding sensitive personal information. UpChat does not use sensitive personal information to infer characteristics about you for purposes that require an opt-out under applicable law.

5. Rights That May Apply to You

Depending on your state of residence, you may have some or all of the following rights:

Right to know — what personal information we collect, use, disclose, and retain
Right to access — obtain a copy of the personal information we hold about you
Right to correct — request correction of inaccurate personal information
Right to delete — request deletion of personal information, subject to legal exceptions
Right to portability — receive a portable copy of certain personal information
Right to opt out — of the sale or sharing of personal information (not applicable to UpChat’s current practices; see Section 2)
Right to limit — use of sensitive personal information where required by law
Right to non-discrimination — we will not discriminate against you for exercising privacy rights
Right to appeal — if we deny your request, you may appeal in states that require an appeals process

These rights may apply to residents of California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, and other U.S. states with comprehensive privacy laws, as each law permits.

6. How to Exercise Your Rights

To exercise a privacy right, email support@upchat.io with the subject line “Privacy Rights Request” and include:

Your full name
The email address associated with your UpChat account (if you have one)
The right you wish to exercise
Your state of residence
Enough detail for us to understand and process your request

We will verify your identity before fulfilling certain requests. We generally respond within 45 days, or the timeframe required by applicable law. If we need more time, we will notify you as required by law.

If you interacted with an UpChat chatbot on another company’s website, that business is typically the controller of your personal information. Please contact that business first. If you need help identifying the right party, email us and we will assist where we can.

7. Authorized Agents

You may use an authorized agent to submit a request on your behalf where your state’s law allows it. We may require proof of authorization and direct verification of your identity.
